1. Definitions & Interpretation

1.1 In these terms and conditions:

1.1.1 “Customer” refers to the individual or entity purchasing products from Wetherby Furnishings.

1.1.2 “Wetherby Furnishings” refers to our company, Wetherby Furnishings, specialising in garden furniture.

1.1.3 “Contract” refers to any agreement between Wetherby Furnishings and the Customer for the sale and purchase of products, subject to and incorporating these terms and conditions.

1.1.4 “Products” refers to any items agreed upon in the Contract to be supplied to the Customer by Wetherby Furnishings.

2. Entire Agreement

2.1 The Contract shall be governed by these terms and conditions to the exclusion of all other terms and conditions.

2.2 No terms or conditions provided by the Customer shall form part of the Contract unless expressly agreed in writing by Wetherby Furnishings.

3. Order Process

3.1 All orders placed by the Customer are subject to acceptance by Wetherby Furnishings.

3.2 Order acknowledgments sent by Wetherby Furnishings are not confirmation of order acceptance.

3.3 Acceptance of the Customer’s order occurs upon dispatch of the Products, unless otherwise notified.

4. Description And Pricing

4.1 Product descriptions are as displayed on the Wetherby Furnishings website at the time of ordering.

4.2 Descriptive materials are provided for guidance and do not form part of the Contract.

4.3 Prices displayed are accurate to the best of our knowledge, and errors will be rectified promptly.

5. Delivery

5.1 Delivery will be made to the address specified by the Customer.

5.2 Customers may be required to provide proof of identification before delivery.

5.3 Delivery dates provided are estimates, and time is not of the essence.

6. Risk

6.1 Risk transfers to the Customer upon delivery, except for goods shipped outside the UK, Ireland, and Channel Isles, where risk transfers at the time of shipping.

7. Payment

7.1 Payment can be made using any method specified on the Wetherby Furnishings website.

8. Customer’s Right Of Cancellation Under The Consumer Protection (Distance Selling) Regulations 2000

8.1 Customers may cancel the Contract within 7 working days of product delivery, subject to certain exclusions.

8.2 The right to cancel does not apply to certain products as outlined in these terms and conditions.

8.3 Cancellation must be communicated in writing to Wetherby Furnishings.

8.4 Customers are responsible for returning the Products at their own cost.

8.5 Products must be returned in their original condition.

8.6 Refunds will be issued within 30 days of cancellation, minus any applicable charges.

9. Limitation Of Liability

9.1 Wetherby Furnishings’ liability is limited to the Contract price, except in cases of fraud or personal injury.

9.2 Wetherby Furnishings shall not be liable for indirect or consequential losses.

10. Assignment

10.1 Wetherby Furnishings may assign the Contract to a third party.

10.2 Customer assignment of the Contract requires written consent from Wetherby Furnishings.

11. Unforeseeable Delays

11.1 Wetherby Furnishings reserves the right to defer delivery or cancel the Contract due to circumstances beyond its control.

11.2 Customers may terminate the Contract if delays exceed 90 days.

12. Export Of Products

12.1 Products may be sold for export, subject to compliance with applicable laws and regulations.

12.2 Ownership and risk transfer terms apply to international deliveries.

13. General

13.1 Each right or remedy of Wetherby Furnishings is without prejudice to any other right or remedy.

13.2 If any provision of the Contract is found to be illegal or unenforceable, it shall be deemed severable.

13.3 Failure to enforce any provision of the Contract does not constitute a waiver of rights.

13.4 Waiver of any breach shall not affect other terms of the Contract.

13.5 Third-party rights under the Contract are excluded.

13.6 The Contract is governed by English law and subject to the exclusive jurisdiction of English courts.

Additional Terms For Business Customers

14. Delivery

14.1 Alternate delivery terms may apply for business customers.

15. Products Purchased On Credit Terms

15.1 Invoices for credit purchases must be paid within 30 days.

15.2 Late payments may incur interest charges.

15.3 Title and ownership of Products remain with Wetherby Furnishings until full payment is received.

16. Quality

16.1 Warranties for Products are provided by manufacturers.

16.2 Implied warranties are excluded to the fullest extent permitted by law.

17. No Cancellation Rights

17.1 Consumer cancellation rights do not apply to business customers.

18. Returns

18.1 Returns are subject to Wetherby Furnishings’ approval and may incur restocking charges.

18.2 No returns are accepted for international orders.

These terms and conditions constitute the entire agreement between Wetherby Furnishings and the Customer, superseding any previous agreements or representations. By placing an order, the Customer agrees to be bound by these terms and conditions.
